    The College is seeking feedback on a proposed by-law that would add information to the public register regarding applications for reinstatement that are made to the Executive Committee or Council.

    Background

    At its September meeting, Council passed a by-law amendment that added to the public register certain information about applications made to the Discipline Committee  for reinstatement. Most applications for reinstatement, after revocation has been made by the Discipline Committee, are made to the Discipline Committee. The legislation, however,  also provides for a secound route to seek reinstatement, which is by a written process to the Executive Committee or Council.

    At its December meeting, Council  was in favour of  adding  information regarding Executive Committee or Council decisions on reinstatement applications to the public register.

    In order to effect these changes, Council proposes to make the following by-law, after circulation to its members and other stakeholders.

    By-Law No. 91

    1. Subsection 49(1) of By-law No. 1 (the General By-Law) is amended by adding the following paragraph: 17.2 If an application for reinstatement has been made to the Council or the Executive Committee under s. 74 of the Health Professions Procedural Code, the date on which the Council or the Executive Committee will consider the application, and the decision of the Council or Executive Committee.

    To ensure transparency, the College will post consultation feedback responses on our website, in accordance with our Posting Guidelines. Names of individual participants will not be posted, however the names of organizations will be posted.     All feedback received through the consultation will be carefully reviewed by the College’s Executive Committee and Council.

    While it may not be possible to ensure that every comment or suggested edit received will be incorporated in the final by-law, respondents should have confidence that their comments will always be carefully considered. When Council approves a final version of this bylaw, a copy will be posted on the College website.
