    Council held a special meeting on December 20, 2012. At the meeting Council approved for circulation to the membership a proposed by-law that would permit the College to post the results of the inspections of out-of-hospital premises on the College website.The special meeting was called in light of concern and continued questions about the adequacy and availability of information about premises inspection results.We believe that the implementation of this by-law amendment will, when passed, make the College’s Out-of Hospital Program the most transparent facility-based program in Canada.

    We are seeking your feedback before January 25, 2013.


    The Out-of-Hospital Premises Inspection Program, established in 2010, inspected more than 250 premises in Ontario. Once inspected, premises were graded as: pass, pass with conditions or fail. In premises that fail, physicians must cease practicing those regulated procedures. Premises who have received a pass with conditions outcome can remain operational; however, any identified deficiencies must be corrected.

    This by-law, if passed, would increase the transparency of this program by posting the outcomes or status of inspections that have been carried out since April 2010. In particular, this applies to only the most current outcome or status as of when the by-law comes into effect (in or around January 31, 2013) and every outcome or status thereafter.

    The information included on the College’s website will include the following:

    • An alphabetical list of all premises that includes:
      • The name and address of the premises
      • The current outcome of inspections of premises (pass, pass with conditions, fail)
      • Date of outcome

    In addition to providing the status and outcomes, Council is considering whether or not to include the actual conditions imposed and reasons for failures.

    Proposed By-law No. 85

    Section 49 of By-Law No. 1 (the General By-Law) is amended by adding the following subsection:

    49(3) The register shall also contain the outcome or status of inspections of all premises carried out since April, 2010 under Part XI of Ontario Regulation 114/94, including the relevant date. This paragraph applies to the most current outcome or status as of January 31, 2013, and every outcome or status thereafter.

    Next Steps

    Members are asked to provide the College with feedback by January 25, 2013. This is an abridged consultation period (30 days). Council asked the Minister of Health and Long-Term Care for this shorter circulation period recognizing the importance of moving forward as quickly as possible. She approved the abridgement. We encourage members to get their feedback to us quickly so it can be considered by Council at its next special meeting. Your comments will be uploaded to the website starting January 3, 2012.
